Partner Visa

There are many different types of partner visa to Australia. These include the Spouse Partner Visa, the Defacto Partner Visa, the Interdependent Partner Visa and the Prospective Marriage Partner Visa.

A partner visa application is closely scrutinised by the Department of Immigration and Citizenship. Success in the application is dependent on the quality of evidence of the relationship. The couple applying for the partner visa need to provide documentation that demonstrates (for the 12 months prior to the date of lodging that they have a mutual commitment to a shared life together. Evidence of this shared life needs to be shown over a range of areas, from financial commitment to nature of the household to the social context of the relationship. Each partner must write a personal history statement that outlines their development and future intentions of the relationship. Many applicants fail due to showing insufficient or contradictory information.

A spouse partner visa or a defacto partner visa may initially be temporary, or permanent from the day of granting. The length of the relationship and children influences the partner visa subclass that applies. If the partner visa is initially temporary, the couple must show their ongoing relationship over the first two years to apply for a residency partner visa.

To apply for a Prospective Marriage partner visa, the couple must have physically met and must show that they have arranged to get married within nine months of the partner visa being granted. Where a couple has meet online and wish to apply for the Prospective Marriage partner visa, special attention needs to be paid to verifying and substantiating the partnership.
